You can't be DUI or hit-and-run either. But if you're sober, cooperative with police, and don't yell something belligerent beforehand -- go ahead and kill any cyclist or pedestrian, odds are excellent that you won't face a day of jail time. Even the civil suit might just result in your insurance going up a little, because in many cases it's quite difficult to pursue a civil suit without a criminal charge having been brought.
