Isn't the whole point her chronological age? In Montana, 14 year olds are legally incapable of giving consent, no matter how mature they seem to old dudes or how much in control of the situation old dudes think they are. Even if this old dude thinks she was begging for the D and knew what she was doing, he is simply dead wrong by law -- it's rape, yo. If he doesn't know that, he should step down from the bench.
